Terms of Service

1. Overview and Acceptance

Welcome to Weston Goods. The words “Weston Goods,” “we,” “our,” and “us” refer to the operator of westongoods.com. These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, information, customer service channels, and related services (collectively, the “Services”). Our storefront is powered by Shopify, but products purchased through the store are sold by Weston Goods unless otherwise clearly identified.

By using the Services or placing an order, you agree to these Terms and the policies incorporated by reference, including the Shipping Policy, Refund Policy, and Privacy Policy. If you do not agree, do not use the Services. Please read the policies applicable to your purchase before submitting an order. Nothing in these Terms excludes rights or remedies that applicable law does not permit us to limit.

2. Eligibility, Accounts, and Customer Information

You must be legally capable of entering a binding purchase agreement under the laws that apply to you. If you are a minor, a parent or legal guardian must authorize and supervise your use of the Services as required by applicable law.

You agree to provide accurate, current, and complete information when creating an account, checking out, or contacting us. You are responsible for keeping account credentials confidential, updating your contact details, and notifying us promptly if you suspect unauthorized account activity. We may take reasonable steps to verify an order or account when necessary to prevent fraud or protect customers.

We may suspend access or decline transactions where reasonably necessary for security, suspected fraud, misuse, legal compliance, or other legitimate operational reasons, subject to consumer rights and any applicable notice or refund requirements.

3. Product Information, Availability, and Sizing

We strive to describe products accurately, including their features, materials, colors, sizes, shipping origin, return eligibility and availability. Photographs and screen displays can vary due to lighting, device settings, and manufacturing tolerances. Please consult the product description, measurement chart and selected variant before buying. Product listings for overseas-shipped final-sale items should display that designation prominently before checkout. A product identified as “plus size,” “oversized,” “stretchy,” or similar is described according to that listing; consult measurements rather than assuming standardized sizing.

Product listings, availability, assortments, and supplier information may change. We do not guarantee that every product will remain available or that a displayed quantity is error-free. If an item becomes unavailable after ordering, we will contact you about applicable options, including cancellation and a refund of amounts payable for the unavailable merchandise in accordance with law.

Products must be used in accordance with their instructions, warnings, and intended purposes. Nothing in these Terms limits your rights concerning misdescribed, defective, unsafe, or otherwise nonconforming products.

4. Orders, Acceptance, and Fraud Review

Submitting an order is an offer to purchase the selected goods under the prices and conditions disclosed at checkout. An automated order acknowledgment confirms receipt but does not necessarily mean that Weston Goods has accepted the order. Acceptance occurs when we confirm acceptance or begin fulfilling it, subject to applicable law. We may decline or cancel orders for legitimate reasons, including unavailable stock, payment errors, pricing errors, suspected fraud, supply restrictions, and delivery limitations.

Where an order is cancelled by Weston Goods before shipment, we will refund the applicable amounts as required. If we need to verify an order, we may contact you through the email or telephone number provided at checkout. You are not required to send payment card passwords, full card numbers, or other sensitive security credentials by email or text.

Please review your order, quantity, selected variants, contact details, and address carefully before final submission. A request to change or cancel an order should be sent promptly to Info@westongoods.com. Requests may not be possible once fulfillment begins, except when cancellation or refund rights apply under law or a published policy.

5. Pricing, Payment, Taxes, and Shipping Charges

Prices are stated in the currency shown at checkout, generally U.S. dollars unless another currency is expressly displayed. The total price, applicable taxes, shipping charges, and other mandatory charges will be presented before order submission as required by law. Prices and offers may change prospectively without notice, but an accepted order will not be repriced without lawful grounds and appropriate notice or customer consent.

Payment must be completed using an accepted method shown at checkout. We may use third-party payment processors. By submitting payment information, you represent that you are authorized to use that payment method. Payment authorization and settlement are subject to the rules of the payment provider and applicable law.

Shipping rates may depend on the product, supplier, shipment, service level, weight and delivery destination. Multiple items may ship separately and may incur item-specific shipping charges, but applicable charges must be disclosed before the order is placed. For eligible voluntary returns or exchanges of U.S.-shipped products, customers pay the cost of tracked return shipping and applicable replacement shipping, as described in the Refund Policy. A 20% restocking fee on the returned merchandise price may apply to authorized voluntary returns when clearly disclosed before purchase and allowed by law. No separate 2% return processing charge is imposed. We do not impose undisclosed automatic address-correction percentage fees.

6. Discounts, Promotions, Gift Cards, and Loyalty Offers

Promotional codes, sale pricing, free gifts, loyalty rewards, and special offers are subject to the eligibility rules, dates, exclusions, and limits clearly stated with the offer. Unless explicitly permitted, promotions may not be combined with other discounts. A discount code may be limited to qualifying full-price merchandise and may exclude already discounted products, gift cards, or products participating in a separate bundle or volume offer.

We reserve the right to correct an unintended promotional error or prevent fraudulent promotion use, consistent with applicable laws and the terms disclosed at the time of purchase. Gift cards and stored-value products, if offered, are also subject to any terms displayed when purchased and to mandatory gift-card protection laws.

Any loyalty, referral, or rewards program has its own published program terms, if applicable. Participation is voluntary; rewards do not create a cash entitlement unless expressly stated or required by law.

7. Shipping, Processing, and Delivery

Shipping arrangements, charges, processing, transit estimates, multiple-package fulfillment and international shipping are explained in our Shipping Policy, which forms part of these Terms. Some items are dispatched from domestic suppliers and others from third-party or overseas suppliers. Product shipping origin affects the availability of discretionary returns, as specified in the Refund Policy and disclosed before checkout; the customer’s delivery address does not determine the shipping origin.

Shipping and delivery estimates are not guaranteed dates unless we expressly identify them as guaranteed. We will comply with applicable laws concerning shipping representations, notices of delays, cancellation options, and refunds for unshipped merchandise. Any allocation of risk of loss or damage in transit will depend on the nature of the shipment, the applicable contractual terms, and governing law; there is no blanket rule in these Terms that all risk passes to the customer immediately upon carrier handoff.

8. Customer Responsibility for Shipping Address Accuracy

When placing an order, you agree to provide a complete and deliverable shipping address, including the correct recipient name, street and unit details where applicable, city, state or region, postal or ZIP code, and country. If you discover an error, contact Info@westongoods.com immediately with the order number and corrected details.

We will make reasonable efforts to correct an address before dispatch, but changes cannot be guaranteed after order processing or shipment begins. If reliable delivery evidence establishes that a package was delivered to an incorrect address provided by the customer at checkout, Weston Goods generally will not supply a free replacement or refund solely because of that customer-provided error, except where legally required.

We will review the facts of disputed deliveries, including potential errors by Weston Goods, fulfillment partners, or carriers. A tracking scan marked “delivered” alone is not automatically conclusive. A verified merchant or fulfillment error, or carrier misdelivery to an address other than the one shown on the shipment, is not treated as a customer-provided address error.

Actual carrier redirection, return-to-sender, or reshipment fees resulting from an inaccurate customer-supplied address may be payable by the customer. Charges for any additional paid service will be disclosed for approval before the service is arranged. Nothing in this section waives statutory remedies, mandatory refund rights, or a customer's right to raise a legitimate payment dispute. This section applies to orders placed after these updated Terms are published.

9. Lost Packages, Late Shipments, and Delivery Investigations

For tracking discrepancies, significant delays, missing items, reported theft, or suspected misdelivery, email Info@westongoods.com with the order number and relevant details. We may review order records, carrier scan data, proof of delivery, and fulfillment documentation, and ask for additional reasonable information to investigate.

We will assess whether the issue arose from a customer-entered address, merchant or supplier error, carrier action, or other circumstances and provide a response and remedy consistent with the evidence, our published policies, and applicable law. If we cannot ship on time, we will provide any legally required delay or cancellation notice and refund rights. Customers retain payment dispute and consumer protection rights that cannot be waived by these Terms.

10. Returns, Exchanges, Refunds, and Damaged Goods

Returns and refunds are governed by the Refund Policy and applicable consumer law. For new purchases after the revised policies are published, eligible products dispatched from within the United States generally require a voluntary return or exchange request within three (3) calendar days after confirmed delivery. The delivery date itself is day zero; the next calendar day is day one. Items shipped from overseas and clearly identified as final sale before purchase are generally not eligible for voluntary size, fit, color, preference or change-of-mind returns. These restrictions do not defeat mandatory consumer rights.

For eligible voluntary returns, the item must satisfy the conditions in the Refund Policy, including remaining new, unworn, unwashed and returned with required tags, packaging and complete components. Request written authorization before shipping an item back. Customers pay their own tracked return-shipping costs and, when properly disclosed before checkout and allowed by law, a restocking fee equal to 20% of the merchandise purchase price may be deducted from an approved voluntary return. Supplier shipment deadlines may vary and will be supplied in the authorization; the three-day request window does not mean a package must reach the warehouse in three days.

Contact us promptly if goods arrive damaged, defective, incorrect or materially different from the description, or if a shipment fails to arrive. We will review the circumstances and provide legally required remedies; non-waivable rights are not defeated by the three-day voluntary return window, an overseas final-sale designation, a restocking fee, or customer-paid voluntary return-shipping terms. Any approved refund will use the method and timeline stated in the Refund Policy except where applicable law requires otherwise. Our policies do not prevent customers from exercising statutory cancellation, warranty, or payment-dispute rights.

11. International Orders, Customs, and Local Rights

We only ship to destinations offered at checkout. Import rules, taxes, customs duties, and restrictions can vary by destination. Unless checkout expressly says otherwise, customers may be responsible for import duties, government fees, and other legally payable destination charges. Customs delays can extend delivery times.

These Terms do not remove mandatory rights that apply to customers outside the United States, including local consumer cancellation, withdrawal, delivery, refund, product-conformity and privacy rights. For example, eligible consumers in the European Union generally have a statutory 14-day withdrawal right for distance purchases, subject to legal exceptions. Required statutory refunds and shipping-cost obligations are determined by the applicable law, not by our U.S. voluntary return rules. If a provision is inconsistent with mandatory law, that law prevails.

12. Intellectual Property and Permitted Use

The design, written content, original graphics, logos, trademarks, product photography owned or licensed by Weston Goods, and other elements of the Services are protected by applicable intellectual property laws. You may browse the store and use its content for personal, noncommercial shopping purposes. Except as permitted by law, you may not reproduce, distribute, sell, republish, remove ownership notices from, or exploit protected materials without permission from the rights holder.

Third-party brand names, suppliers' materials, and trademarks remain the property of their respective owners. No license or ownership right is granted merely by visiting the Services or purchasing a product.

13. Customer Content, Ratings, Reviews, and Feedback

If you submit reviews, comments, photographs, suggestions, or other content (“Customer Content”), you affirm that you have the right to share it and that it is accurate to the best of your knowledge, lawful, and does not violate third-party rights. Do not include sensitive personal, financial, or medical information in public reviews.

To operate and promote the Services, you grant Weston Goods a nonexclusive, worldwide, royalty-free license to display, reproduce, format, and share Customer Content submitted for publication in connection with the store and its products, subject to applicable law and our Privacy Policy. You retain ownership of content you create. We may remove content that violates these Terms, is fraudulent or unlawful, or poses privacy or safety risks; we do not promise to publish every submission.

Reviews should reflect genuine customer experiences. We do not require only positive feedback and will not misrepresent reviews or incentives.

14. Prohibited Uses, Security, and Fair Access

You agree not to use the Services to commit fraud; impersonate others; violate applicable laws; infringe intellectual property or privacy rights; upload malware; interfere with checkout, systems, or other customers; harass staff or users; attempt unauthorized access; circumvent security controls; or submit misleading payment or shipping information.

You may not use the Services to collect personal data unlawfully or to overload, disrupt, or damage our systems. We may implement reasonable technical measures and take proportionate action to address prohibited activity, subject to applicable law.

15. Search Engines, Automated Tools, and AI Agents

Publicly accessible product and editorial pages may be indexed by ordinary search engines and legitimate product-discovery tools in accordance with applicable law, published site directives, and reasonable access controls. We may restrict unauthorized bulk scraping, circumvention of technical protections, fraudulent automated purchasing, credential harvesting, or actions that degrade store performance.

Automated tools acting on behalf of customers must respect our security checks and accurately represent the shopper's selections and authorization. Automated access does not give any visitor or agent ownership of store content, a right to bypass checkout controls, or authority to place purchases without the customer's consent.

16. Third-Party Services, Links, and Integrations

The Services may link to third-party sites or use services such as Shopify, payment processors, shipping carriers, analytics tools, reviews, and product fulfillment partners. Third parties may have separate terms and policies. Links do not necessarily mean Weston Goods endorses all third-party content. To the extent allowed by law, we are not responsible for external websites that we do not control; however, we remain responsible for our own obligations as seller where applicable.

17. Relationship with Shopify

Shopify provides technology that powers our storefront and may process information under its own applicable terms and privacy practices. Unless clearly stated otherwise at checkout, your retail purchase is from Weston Goods, not Shopify. Contact Weston Goods for questions about products, fulfillment, delivery, returns, and order disputes.

18. Privacy and Communications

Our handling of personal information is described in our Privacy Policy. We use order contact information to process purchases, provide service updates, investigate problems, and communicate as permitted by law. Marketing communications, where offered, are subject to applicable consent and unsubscribe requirements. Do not assume that subscribing to marketing is required to place an order unless clearly disclosed and lawfully permitted.

19. Errors, Changes, and Store Availability

Although we work to keep information accurate, typographical or technical errors may occur in product descriptions, inventory, prices, offers, shipping estimates, and other store content. We may correct information prospectively and take lawful steps concerning affected orders, including notifying customers and providing required cancellation or refund options.

We may improve, modify, or temporarily interrupt features for maintenance, security, or operational reasons. We do not promise uninterrupted access or an error-free website. We will not use this clause to deny mandatory obligations regarding accepted orders or customer purchases.

20. Disclaimer of Warranties

To the extent permitted by law, the website and non-product informational features are provided on an “as available” basis without guarantees of uninterrupted availability or freedom from technical error. Product warranties, statutory product-conformity obligations, and other non-excludable consumer protections remain in effect. We do not disclaim warranties or remedies where such a disclaimer is prohibited or unenforceable.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Weston Goods is not liable for indirect, special, incidental, or consequential losses arising from use of the website when such exclusions are legally allowed and reasonably applicable. This clause does not exclude or limit liability for fraud, intentional misconduct, injury, product defects, statutory consumer rights, refunds legally owed, or other liabilities that applicable law does not allow to be limited or excluded.

Nothing here makes a customer responsible for a loss caused by our own wrongdoing, or makes a tracking record conclusive proof that a disputed delivery was correctly completed. Any remedy or liability determination will depend on the facts and applicable law.

22. Indemnification

To the extent permitted by applicable law, if your intentional misconduct or unlawful use of the Services directly causes a third-party claim against Weston Goods, you agree to be responsible for losses and reasonable costs legally attributable to that conduct. This provision does not apply to claims caused by Weston Goods, its suppliers, or its own negligence or unlawful actions and does not restrict consumer rights.

23. Suspension and Termination

We may suspend or terminate access to an account when reasonably necessary to address unlawful activity, security threats, payment fraud, or serious violations of these Terms, subject to legal requirements. Termination of website access does not cancel rights or obligations associated with an accepted order unless that order is lawfully cancelled or otherwise resolved.

24. Governing Law and Disputes

Except where mandatory consumer law provides otherwise, these Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules. Any dispute will be handled in a court of competent jurisdiction under applicable law. This clause does not deprive consumers of a forum or protection guaranteed by mandatory law in their place of residence.

Before formal action, customers are encouraged—but not required—to email Info@westongoods.com with the order number and details so we can attempt to resolve the matter. Customers retain lawful rights to contact regulators, submit payment disputes, or pursue other available legal remedies.

25. Entire Agreement, Severability, and Waiver

These Terms and the policies expressly incorporated by reference form the applicable agreement concerning use of the Services, except for separate specific terms clearly disclosed for certain promotions or programs. If any provision is held invalid or unenforceable, the remaining provisions remain in effect to the extent legally permitted. Our failure to enforce a provision in one instance is not a permanent waiver of that provision.

Headings are for readability and do not change the meaning of the Terms. You may not transfer your account or contractual rights in a way that violates applicable law or harms other customers. Any transfer by Weston Goods is subject to law and does not diminish existing customer rights.

26. Changes to These Terms

We may update these Terms as our operations, technology, or legal requirements change. The current version will be made available on our website. Where required, we will provide notice of material changes. Changes will apply prospectively, and the terms governing a purchase will not be retroactively changed to remove rights or remedies that existed when the order was placed.

Effective date: These revised Terms take effect when published and apply to orders placed after publication, subject to mandatory law. Previous completed orders remain subject to the applicable terms at the time of purchase.
